1. Closing Services as per work described/selected on the Closing Contract. Pools Today will not be expected to perform any work other than that which is herein contracted. Pools Today cannot be held responsible for damages created by other persons.
  2. Water/excess debris from the top of the cover must be removed before a service visit may take place. If an additional trip/time is required, Customer will be billed additionally on a time and materials basis.
  3. Pools Today is not responsible for any items under the care of the homeowner during winter months.
  4. All items must be out and accessible at the time of closing. Any winter plugs or other necessary equipment that is missing or defective will be replaced (if on the service truck) and billed at an additional charge. We can supply winterizing plugs for an additional $50. If all necessary items are not available on arrival, the pool closing will need to be rescheduled through the office.
  5. At closing, Pools Today will not be responsible for any missing or damaged items of pool equipment stored on the Owner’s property under their care and keeping over the summer months.
  6. Pools Today must have access to the property, pool/pool equipment area, outside working electrical outlets, and outside working water spigots. If these working conditions are not met, return trip fees at normal service rates may be incurred.
  7. Pools Today is not responsible for draining the pool and/or spa to closing height. Water should be drained to the bottom of the skimmer.
  8. Pools Today will not be held responsible and/or liable for damages or added expense due to delays of the contract date caused by shortages, including but not limited to availability of parts, accessories, weather conditions, acts of God, or other circumstances beyond the control of Pools Today. Service/repair work needed to complete the closing may be rescheduled at our earliest convenience.
  9. If Pools Today cannot finish closing on the first attempt, a return visit fee will apply when we return to finish closing the pool/spa, plus materials if materials are needed.
  10. Due to circumstances outside Pools Today’s control, Pools Today does not warranty pool service work or make an expressed or implied warranty of pool structure, deck, piping, or any associated pool equipment.
  11. Pools Today does not assume responsibility and/or liability for damages to lawns, shrubbery, or landscaping/hardscape — including potential run-off to neighboring properties — due to backwashing, draining, and/or cleaning the filter, or due to antifreeze or chemicals from the closing process or the pool water.
  12. Automation probes will be removed and capped with customer-provided saline solution. Homeowners must keep probes indoors in a warm area during the winter season and are to provide instructions on where to leave the probes.
  13. Filter cartridges will be removed from the filter and left near the equipment pad, unless the homeowner provides instructions on where to leave them prior to the scheduled appointment.
  14. Any changes or amendments to this agreement must be made in writing, constitute the entire contract of the parties, and be signed by both parties to be binding. This contract shall not be binding until Pools Today receives an accepted contract. Pools Today reserves the right to terminate this contract at any time.
  15. Pools Today assumes no liability for damage to the pool/spa structure, equipment, plumbing, or related components caused by freezing temperatures, ice, or other weather-related conditions.
  16. Any closing scheduled after November 1 will be subject to a $100 additional fee due to weather conditions.
